Terms and Conditions

These Terms and Conditions govern your access to and use of the RefleXn website and LeXz, the self-serve online challenge available on the website (together, the "Online Service"). The Online Service is operated by Darfun Labs ("we", "our" or "us").

RefleXn facilitated events are separately arranged services. Their booking, delivery, cancellation, venue, participant and event-specific requirements will be communicated in the relevant quotation, booking confirmation or separate event terms. If those event-specific terms conflict with these Terms, the event-specific terms will apply to the facilitated event.

By accessing or using the Online Service, or by making a purchase through it, you agree to these Terms and our Privacy Policy. Additional rules displayed for a particular challenge, promotion or feature also apply to that offering.

1. Eligibility

   You must be at least 18 years old to accept these Terms or make a payment on your own behalf. A person under 18 may use LeXz only with the involvement, permission and supervision of a parent, legal guardian or other adult authorised to supervise them. Where applicable law requires parental or guardian consent for the processing of a child's personal data, that consent must be obtained before the data is collected or processed.

2. Online Service

   LeXz is a self-serve, interactive challenge that may use movement, body-position or other camera-based interaction to support gameplay. Available interaction modes and features may change over time.

   The Online Service is provided for entertainment, learning and engagement. It is not medical advice, diagnosis or treatment, and is not a substitute for professional training or formal education.

3. License and Intellectual Property

   Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Online Service for its intended purpose.

   You must not copy, modify, distribute, reverse engineer, create derivative works from, resell, commercially exploit or make the Online Service available to others except where we expressly permit this in writing or applicable law allows it.

   All intellectual property rights in RefleXn and LeXz, including software, game mechanics, artwork, content, names, logos and related materials, belong to Darfun Labs or its licensors. These Terms do not transfer ownership of any intellectual property to you.

4. Physical Activity and Safety

   Some LeXz interaction modes may involve reaching, stepping, sideways movement, clapping or jumping. You are responsible for choosing a mode suitable for your abilities, surroundings and circumstances.

   Before starting a movement-based mode, clear the play area of furniture, obstacles, pets, other people, loose objects and other hazards. Avoid playing near stairs, glass, sharp edges or other dangerous surfaces. Follow the on-screen positioning instructions and keep a safe distance from your device and display.

   Do not participate in a movement mode that is unsuitable for you or your environment. Stop immediately if you feel unwell, uncomfortable or unsafe. LeXz does not assess whether an activity is suitable for any individual and does not provide medical advice.

5. Camera and Device Requirements

   Features that use camera-based movement tracking require camera permission. Camera input and movement tracking are processed locally in your browser or application on your device. If you deny camera permission, or your device or browser does not support the required features, those features may not work.

   You are responsible for your device, internet connection, browser compatibility, camera quality, camera permissions and appropriate device positioning.

6. Scores and Leaderboards

   Where leaderboard features are available, LeXz may process challenge results such as completion times, selected modes and display names to operate and display rankings. The information displayed and the visibility of a leaderboard will be described in the relevant feature.

   You must not manipulate scores, interfere with another user's participation or attempt to compromise the integrity or security of a challenge. We may withhold, remove or correct results where we reasonably believe there has been cheating, misuse, a technical error or a breach of these Terms.

   You may contact us using the details below to request removal or correction of a leaderboard entry, subject to applicable law and legitimate recordkeeping requirements.

7. Payments, Cancellations and Refunds

   Any price, applicable tax, payment method, access period and purchase condition for a paid Online Service feature will be shown before purchase. Payments may be processed by third-party payment providers and may also be subject to their terms.

   Unless a specific offer states otherwise, digital access that has been supplied, or a service that has been completed, is not refundable except where a refund or other remedy is required by applicable law. If a payment is charged more than once due to a payment-processing error, contact us with the transaction references so that we can investigate and arrange any confirmed correction.

   Bookings for facilitated RefleXn events are not governed by this online refund clause. Cancellation, rescheduling, event delivery and refunds for those events will be set out in the applicable quotation, booking confirmation or separate event terms.

8. Acceptable Use and Suspension

   You must not misuse the Online Service, interfere with its operation or security, attempt to manipulate results, harass or harm others, infringe intellectual property rights, introduce malicious code or use the Online Service unlawfully.

   We may restrict, suspend or terminate access where we reasonably consider that you have materially breached these Terms, created a security risk or misused the Online Service. Where appropriate and legally permitted, we may provide an explanation and an opportunity to resolve the issue. Termination does not affect rights or obligations that accrued before termination.

9. Availability and Changes

   We aim to keep the Online Service available and functioning, but do not guarantee uninterrupted access, error-free operation, compatibility with every device or browser, or continued availability of any particular feature. Service interruptions may result from maintenance, network failures, third-party services, device issues or events beyond our reasonable control.

   We may update, modify, suspend or discontinue features for operational, security, legal or product reasons. We may also update these Terms by publishing a revised version on this page and changing the date above. For material changes, we will take reasonable steps to provide notice where appropriate. Changes will apply from the stated effective date and will not remove rights that cannot lawfully be removed.

10. Disclaimer and Limitation of Liability

    The Online Service is provided on an "as is" and "as available" basis, to the fullest extent permitted by law. We do not warrant that it will be uninterrupted, error-free, suitable for every purpose or compatible with every device or browser.

    To the fullest extent permitted by applicable law, Darfun Labs will not be liable for indirect, incidental, special, exemplary or consequential loss arising from use of, or inability to use, the Online Service.

    Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any liability that applicable consumer protection or other law requires us to retain. Subject to that restriction, our total liability arising from the relevant Online Service will not exceed the amount you paid us for that Online Service in the twelve months before the event giving rise to the claim. Where no amount was paid, any limitation will apply only to the extent permitted by applicable law.

11. Indemnification

    To the extent permitted by applicable law, you are responsible for claims, losses and reasonable costs arising directly from your unlawful use of the Online Service, your infringement of another person's rights, or your material breach of these Terms. Nothing in this clause requires you to indemnify us for our own negligence, wilful misconduct or any liability that cannot lawfully be transferred to you.

12. Third-Party Services

    The Online Service may rely on third-party websites, hosting, communication, payment or technology services. Those services may be governed by separate terms and privacy policies. We are not responsible for third-party services to the extent permitted by applicable law, but this does not affect any rights you may have against us under applicable law.

13. Governing Law and Disputes

    These Terms are governed by the laws of India. Subject to any mandatory rights or jurisdiction available under applicable law, courts of competent jurisdiction in Bengaluru, Karnataka will have jurisdiction over disputes relating to these Terms or the Online Service.

14. Changes to the Operator

    We may transfer or reorganise the operation of the Online Service as part of a business restructuring or transfer, subject to applicable law. If the identity of the operator changes materially, we will update the relevant information and provide any notice or obtain any consent required by law.
